Migration Strategy changes to conditions 8107, 8607 and 8608 pf Work Sponsored Visas

From 1 July 2024, conditions 8107, 8607 and 8608 of the Migration Strategy will be changed. This is to make improvements for migrants with the following visas: 

  • Temporary Work (Skilled) visa (subclass 457)

  • Temporary Skill Shortage visa (subclass 482)

  • Skilled Employer Sponsored Regional (provisional) visa (subclass 494).

How do the changes affect the holders of these Visas?

  • Holders of this Visa have 180 days to find a new sponsor once employment ceases and 365 days in total for the duration of their Visa

  • While looking for a new sponsor, the worker is still able to work, including working in occupations not under their nominated work in order to support themselves

  • They cannot work at other employment while under their sponsorship and must only work in their nominated occupation.

  • Sponsors must notify the Department of Home Affairs of any changes within the prescribed 28 day notice period (including the cessation of sponsorship or resignation of visa holder)

  • Any period of time a visa holder has not been in employment with a sponsor prior to 1 July 2024 does not count to new criteria
