The Resident Return Visa is a visa for Australian permanent residents, former Australian permanent residents whose visa was not previously cancelled, and for any Australian citizens who revoked their Australian citizenship.
This visa allows for the resident to apply to renew their permanent residency visa and be able to travel in and out of Australia through an ‘international travel facility’ for the time stipulated in their visa conditions.
To be eligible for the resident return visa subclasses 155 and 157, the applicant must satisfy the following criteria:
Conditions regarding Australia
Must be present in Australia for 2 of the last 5 years as the holder of a permanent visa (or permanent entry permit), or as an Australian citizen. In this case one is eligible for a 5-year travel facility.
Demonstrate substantial ties to Australia.
If a member of family holds or has applied for an RRV, and meets the application criteria, a 12-month travel facility is available.
Outside Australia
Cannot be outside Australia for five continuous years. If the applicant has been absent, they must provide compelling reason OR have substantial ties to Australia (a 12 months travel facility is available)
The applicant was an Australian citizen less than 10 years ago, and/or not absent from Australia for more than 5 years. If the applicant was absent, they must provide compelling reason OR have substantial ties to Australia (a 12-month travel facility is available)
What is meant by ‘substantial ties to Australia?’
Substantial ties include:
Business ties – examples include business transactions, company acknowledgement of role, contract showing your signature etc.
Cultural ties – evidence of cultural association, publications in newspapers about/written by you etc.
Employment ties – employment contracts, letter of offer, employee identification etc.
Personal ties (including family ties) – partner in Australia, family in Australia, history of long term residence in Australia etc.
Further criteria requirements:
Not hold an Authority to Return or Return Endorsement
Not eligible if you hold a transitional permanent visa
Meet character requirement which include not having a substantial criminal record etc.
Not have cancellation action against your business skills visa
Not eligible for this visa if you have the following: Class EA subclass 132 visa, Class BH subclass 840-846 visas (repealed), Class EB subclass 188 visa, Class UR subclass 160-165 visas, Class EC subclass 888 visas
Not have had a visa cancelled or a previous application refused
Satisfy health criteria
